cannot run mysql_upgrade

After substituting the data folder for an earlier db created in mysql 5.1 I get the following when starting the windows service.

2016-01-29T11:04:24.514559Z 0 [ERROR] Fatal error: mysql.user table is damaged. Please run mysql_upgrade.
2016-01-29T11:04:24.516559Z 0 [ERROR] Aborting

So I try to run mysql_upgrade and get:

mysql_upgrade: Got error: 2003: Can't connect to MySQL server on 'localhost' (10061) while connecting to the MySQL server
Upgrade process encountered error and will not continue.

my does it ask you to run mysql_upgrade for a fatal error that prevents the server running if the server has to be running to run mysql_upgrade? I don't understand. Also I thought I might have to tell mysql_upgrade the datadir but that options appears to not be used by mysql_upgrade.

Any ideas?
