The lack of UTF8 support is a documented bug in the MySQL ODBC drivers. It's to be addressed in the 3.53 release of ODBC.

This has become a major sense of frustration for me. The beta .NET Connector now supports UTF8; however, I am getting so many critical exceptions from the beta connection that I cannot use it.

The MySQL folks have done so far a very good job with the MySQL 4.1. But I just wish that they hadn't stated that it's Unicode-compliant. The database may be, but the connectors aren't.
