Change in start-up behavior

We've recently moved from 5.0.27 to 5.0.51a on a Windows platform, and have observed a change in the start-up behavior of the server.

The third-party application we're running potentially launches MySQL from differing points in its start-up process. The scripts have relied on the behavior in 5.0.27 by which starting a second server instance with the same port number would fail; thus, regardless of the number of times the launch script was invoked, a single instance would be running.

With 5.0.51a, however, we see another instance of the server launched with each invocation of the script. Can someone explain what's happening here?
