MySQL products are distributed under two licenses: GPL and Commercial.
Under GPL license you can use the community versions of MySQL products, but your own product must be GPL-compliant. You can check the GPL license details on GNU project page:
https://www.gnu.org/
The commercial license for MySQL products is required if you want to re-distribute them as a part of your non-Free product. There are many other scenarios when Commercial license might be required.
The starting point would be checking if your product complies to ALL requirements of GPL license. If this is the case you are allowed to use the free community versions of MySQL products including ODBC driver and re-distribute them along with your own programs that also must go under GPL license.
