### Please ignore this question, I have solved it ###
I was entering the date as date("Y-m-s H:i:s") rather than date("Y-m-d H:i:s") the problem only happened occasionally when the second value of the time was greater than 31 or 30 depending on the date.
I'll kick myself for this.
